100% Satisfaction Guarantee: We hold onto Jewelry for 10 days after we purchase your Jewelry. If for any reason you change your mind, you may notify us and we will happily return your Jewelry. If you cash your check (or if payment is made via PayPal, direct deposit or FedEx) your merchandise will be liquidated and will not be recoverable.

110% Price Guarantee: Our 110% Price Guarantee applies to scrap gold only. You must receive from an advertised and licensed gold buying company with which you have no affiliation an itemized written offer for your scrap gold within 10 days of mailing your gold to gold-cash.com. Send us a copy of their offer, and if their original written offer is more than the offer you receive, we will match their offer (based on that day’s Gold price) plus an additional 10% bonus of the difference in offers. Offer applies to scrap gold only, and does not apply to estate jewelry, coins, bullion, watches or diamond jewelry, among other non scrap gold items.

Representation

By you using this Site, you represent the following:

1. You are 18 years of age or older;
   
   
2. You have authority to sell the Jewelry, are the legal owner of the Jewelry, and that the Jewelry is free and clear of any claims, liens and encumbrances;
   
   
3. You have submitted accurate information;
   
   
4. You are acting on your own and not as an agent or representative of any other person or entity;
   
   
5. You understand and accept all terms and conditions set forth herein and on our website, which are subject to change.
   
   

Process

In order to exchange money for your Jewelry, the following process must occur:

1. Complete the online form with accurate information.
   
   
2. Request a Gold-Cash Kit or Print Your Own Label to send us your Jewelry via FedExTM.
   
   
3. Drop off the FedExTM package by following and complying with the FedExTM insurance policy.  This will require you to physically drop-off the FedExTM package at a designated location and receive a receipt.
   
   
4. Once we receive your Jewelry, you will be notified by email.
   
   
5. Your Jewelry will be cut and filed to precisely determine its content, at which time we will e-mail you our offer.
   
   
6. You must reply to accept or reject our offer.
   
   

Payment Options

If you accept our offer, you must select one of the four payment options. Sale is final when payment is accepted. If you are unsatisfied with our payment offer you may deny payment and we will return your items free of charge:

1. PayPalTM – Payment will be deposited into your account within 24 hours of acceptance and will be available for immediate use.
   
   
2. Wire Transfer – Payment will be wired into your bank account.  A voided check will be required in order to verify account and routing numbers.  There is a $12.50 charge for this transfer, which will be deducted from your payment.
   
   
3. Check via FedExTM Overnight – Payment will be sent by check via FedExTM Overnight Delivery.  There is a $15.00 charge for this transfer, which will be deducted from your payment.
   
   
4. Check via USPS –A company check will be issued and mailed via the USPS.
   
   

Returns

1. Should you decide to reject our offer or change your mind after payment by check, you must notify us immediately by e-mailing us at support@gold-cash.com or calling us at (800) 294-7311.
   
   
2. If you are paid by check, you must notify us within 10 days from the date of issuance on the check.  Once you notify us, you must send the check back within 30 days from the date of issuance on the check.  If you fail to send the check back within the 30 days from the date of issuance on the check, the sale is deemed final.  NO RETURNS AFTER 30 DAYS FROM THE DATE OF ISSUANCE ON THE CHECK.
   
   
3. If we receive the check within the 30 days from the date of issuance on the check and if you notified us within 10 days from the date of issuance on the check, we will return your Jewelry to you via FedExTM
   
   

Guaranty Against Loss

1. We will guaranty the loss of the contents up to the value indicated when shipping or $1,000, whichever is less, when properly shipped to us, in accordance with the process established in Section 1.02, and subject to the Terms and Conditions herein.  If the package appears to be damaged, opened, or tampered with, we reserve the right to reject such package and it will be returned to you.  We shall not be held liable for any rejected package or the return of it.
   
   
2. b) Any jewelry that is returned to you, that has not been subject to rejection of the package, will be guaranteed up to the value of our offer or $1,000, whichever is less.

Limitation of Liability

• In no event shall we be liable to you or any third party for any lost profits, lost savings or incidental, special or consequential damages, arising out of the use of this site or the Gold-Cash, Inc. service. Further, in no event shall we be liable for any damages for any loss or destruction of property in our possession, including but not limited to negligence, except as may be stated herein.  Finally, in no event are we liable to any third party, including but not limited to insurance carriers, nor any subrogation claim brought by your insurance carrier.
  
  

Indemnity

• You agree to indemnify and hold harmless us, our officers, partners, directors, shareholders, agents, and employees from any and all claims resulting from any loss, liability, claim, or demand, including legal expenses and reasonable attorneys’ fees, which arise due to a breach or an alleged breach by you of any warranty or representation or any other provision of this Agreement.
  
  

Choice of Law, waiver and claims

• These terms and conditions and all transactions by us and you will be governed by the laws of the State of New York without regard to its conflict of laws provisions.  If we fail to exercise or enforce any rights or provisions herein, it will not be deemed as to a waiver of these rights and provisions.  If any of these Terms and Conditions are found to be invalid by a court of competent jurisdiction, the parties agree that all other provisions will remain in full force and effect.  You agree and understand that any claim or cause of action must be filed within one (1) year of the date of the initial communication or transaction with us, regardless of any statute or law to the contrary, or forever be barred.  Any such claim or cause of action shall be filed within the exclusive jurisdiction of the state and federal courts located in New York.  We will be entitled to reimbursement by you for any and all costs incurred by a claim or cause of action filed in any jurisdiction outside New York, including but not limited to attorneys’ fees.
  

Force Majeure

• We shall not be liable for any unforeseen event beyond the control of us, including but no limited to “Acts of God,” war, or the failure of third parties.
